Section 30.628 - Special Requirements for Ignitable, Reactive, and Incompatible Hazardous Wastes, and Hazardous Wastes that are Polyhalogenated Aromatic Hydrocarbons(1) Ignitable or reactive hazardous waste shall not be disposed of in a landfill.(2) Incompatible hazardous wastes, or materials incompatible with hazardous wastes (see310 CMR 30.561 for examples) shall not be placed in the same landfill cell unless 310 CMR 30.560(3) is complied with.(3) Polyhalogenated aromatic hydrocarbons shall not be placed in a landfill except in accordance with all other applicable provisions of 310 CMR 30.620 and in accordance with the terms and conditions of a management plan, approved by the Department, for such placement. Compliance with such a plan, when approved, shall be a condition of a license issued pursuant to 310 CMR 30.000. The Department may approve a management plan for the placement of polyhalogenated aromatic hydrocarbons in a landfill only if, after considering at least the following criteria, the Department determines that such approval is in accordance with provisions set forth in 310 CMR 30.810 through 30.814. (a) The volume and physical and chemical characteristics of the polyhalogenated aromatic hydrocarbons, including their potential to migrate through the soil or to volatilize or escape into the atmosphere.(b) The volume and physical and chemical characteristics of the other materials placed into the landfill, including their potential to migrate through the soil or to volatilize or escape into the atmosphere.(c) The attenuative properties of the soil and other materials surrounding or underlying the landfill.(d) The effectiveness of additional treatment, design, or monitoring techniques used by the owner or operator of the landfill. The Department may require the use of additional or different treatment, design, or monitoring techniques to reduce the possibility of migration or emission of these materials into ground water, surface water, soil, or air.
