Section 51.01 - Definitions

Acquisition. Obtaining real property by gift, purchase, devise, grant, eminent domain, rental, rental-purchase, or otherwise.

Article 97 Purposes. The purposes set forth in Article 97 of the Amendments to the Massachusetts Constitution and/or conservation or open space purposes set forth in any other enabling legislation of any EEA Agency.

Central Register. The Central Register published by the Secretary of State of the Commonwealth pursuant to M.G.L. c. 9, § 20A.

DCAMM. The Division of Capital Asset Management and Maintenance of the Executive Office for Administration and Finance.

EEA. The Executive Office of Energy and Environmental Affairs of the Commonwealth.

EEA Agency. The relevant agency, department or division of EEA, including but not limited to the Department of Conservation and Recreation, Department of Fish and Game and its Division of Fisheries and Wildlife, and the Department of Agricultural Resources.

EEA Agency Head. The board or officer of an EEA Agency authorized to acquire real property on behalf of the Commonwealth of Massachusetts.

Public Officials. The city manager in the case of a city under Plan E form of government, the mayor and the city council in the case of all other cities, the chairman of the board of selectmen in the case of a town, the county commissioners, the regional planning agency and the members of the general court.

Real Property. Any interest in real property, including but not limited to fee simple, leaseholds, easements, restrictions and reversions acquired for Article 97 purposes as defined in 301 CMR 51.00.

Secretary. The Secretary of the Executive Office of Energy and Environmental Affairs.
