(1)Authority. 211 CMR 7.00 is promulgated pursuant to the authority granted by M.G.L. c. 175, § 206C.(2)Purpose. The purpose of 211 CMR 7.00 is to set forth rules and procedural requirements which the Commissioner deems necessary to carry out the provisions of M.G.L. c. 175, §§ 206 through 206D. The information called for by 211 CMR 7.00 is hereby declared to be necessary and appropriate in the public interest and for the protection of the policyholders and shareholders in the Commonwealth.(3)Severability Clause. If any provision of 211 CMR 7.00, or the application thereof to any person or circumstance, is held invalid, such determination of invalidity shall not affect other provisions or applications of 211 CMR 7.00 which can be given effect without the invalid provision or application, and to that end the provisions of 211 CMR 7.00 are severable.Amended, Mass Register Issue 1258, eff. 4/11/2014.Amended by Mass Register Issue 1514, eff. 2/2/2024.
