Section 121.15 - Revised Rate Filing
(1)Contents. Within the time period specified in the Presiding Officer's decision, a Filer may file a Revised Rate Filing in the docket opened for the Rate Filing. The Revised Rate Filing must contain all information and meet all other requirements set forth in the Presiding Officer's decision, and must comply with the format, filing and service requirements of 211 CMR 121.05, but otherwise need not comply with 211 CMR 121.05.
(2)Hearing on Revised Rate Filings. The Presiding Officer may hold a Hearing on a Revised Rate Filing, and shall hold a Hearing on a Revised Rate Filing if a Party requests one within five days of the filing of the Revised Rate Filing. At such a Hearing, the Presiding Officer may hear argument and receive evidence regarding compliance with the decision on the Rate Filing. The Presiding Officer shall approve a Revised Rate Filing if it meets the requirements for approval set forth in the decision on the Rate Filing. The Presiding Officer may permit a Filer further to revise a Revised Rate Filing to meet the requirements for approval set forth in the decision on the Rate Filing.
