Section 100.545 - Prerequisites to Department ActionExcept in the case of an emergency Application made pursuant to 105 CMR 100.740, the Department shall not take preliminary or Final Action upon an Application, unless first:
(A) The Application or amendment has been on file with the Department for at least 30 days following the Filing Date and the Applicant has provided a copy to each Party of Record; and(B) A public hearing has been held, if directed by the Commissioner pursuant to 105 CMR 100.445.Adopted by Mass Register Issue S1331, eff. 1/27/2017.Amended by Mass Register Issue 1381, eff. 12/28/2018.
