Section 30180.1 - Exempt Concentrations(a) A person is exempt from the requirements for a license specified in section 30190, sections 30191 through 30235, and from Group 3 of this subchapter, to the extent that such person receives, possesses, uses, transfers, owns or acquires products or materials containing radioactive material in concentrations not in excess of those listed in section 30237.(b) This section shall not be deemed to authorize the import of radioactive material or products containing radioactive material.(c) A manufacturer, processor, or producer of a product or material is exempt from the requirements for a license specified in section 30190 and sections 30191 through 30235, and from Group 3 of this subchapter, to the extent that such person transfers radioactive material contained in a product or material in concentrations not in excess of those specified in section 30237 and introduced into the product or material by a licensee holding a specific license issued by the U.S. Nuclear Regulatory Commission (NRC), expressly authorizing such introduction.(d) The exemptions in this section do not apply to the transfer of radioactive material contained in any food, beverage, cosmetic, drug, or other commodity or product designed for ingestion or inhalation by, or application to, a human being.(e) A person may not introduce radioactive material into a product or material, knowing or having reason to believe that it will be transferred to persons exempt under this section, except in accordance with a specific license issued by the NRC pursuant to section 32.11 in title 10, Code of Federal Regulations, Part 32 ( 10 CFR 32). This provision shall not be construed to incorporate by reference 10 CFR 32, section 32.11.(f) A person is exempt from this subchapter to the extent that such person receives, possesses, uses, transfers, owns or acquires naturally occurring radioactive material in concentrations which occur naturally.
