Section 2061 - Participant Availability

Victims, victim's next of kin, members of the victim's family, victim's representatives, victim's support persons, representatives of the prosecuting agency, visitors, observers, and media representatives shall be available at the start time of the proceeding. Failure to do so shall result in loss of the opportunity to participate in the proceeding if the hearing officer determines it would significantly delay the proceeding or the remaining hearing calendar for the day. The hearing officers shall review any statements submitted under section 2029 of this division and sections 3041.7 and 3043.2 of the Penal Code in accordance with paragraph (1) of subdivision (a) of section 3041.5 of the Penal Code.

Cal. Code Regs. Tit. 15, § 2061

1. New section filed 9-27-2021 as an emergency; operative 9-27-2021 (Register 2021, No. 40). A Certificate of Compliance must be transmitted to OAL by 3-28-2022 or emergency language will be repealed by operation of law on the following day.
2. Refiling of 9-27-2021 order on 3-28-2022 as an emergency, including renumbering of former section 2061 to section 2062 and renumbering and amendment of former 2060 to section 2061; operative 3-28-2022 (Register 2022, No. 13). A Certificate of Compliance must be transmitted to OAL by 6-27-2022 or emergency language will be repealed by operation of law on the following day.
3. Refiling of 9-27-2021 and 3-28-2022 orders on 6-27-2022 as an emergency; operative 6-27-2022 (Register 2022, No. 26). A Certificate of Compliance must be transmitted to OAL by 9-26-2022 or emergency language will be repealed by operation of law on the following day.
4. Certificate of Compliance as to 6-27-2022 order transmitted to OAL 9-26-2022 and filed 11-7-2022 (Register 2022, No. 45).
