Section 2052 - Method of Conducting a Proceeding
(a) A proceeding is conducted by videoconference if the inmate, or the inmate's attorney if the inmate waives participation in the proceeding, communicates by videoconference with all the hearing officers assigned to conduct the proceeding. Neither the inmate nor the inmate's attorney is physically present with the hearing officers.
(b) A proceeding is conducted in person if the inmate, or the inmate's attorney if the inmate waives participation in the proceeding, communicates with all the hearing officers assigned to conduct the proceeding while physically present with the hearing officers.

Cal. Code Regs. Tit. 15, § 2052

1. New section filed 9-27-2021 as an emergency; operative 9-27-2021 (Register 2021, No. 40). A Certificate of Compliance must be transmitted to OAL by 3-28-2022 or emergency language will be repealed by operation of law on the following day.
