Rule 221.00.16-001 - Amendments to Resolution No. 3 of 2015 and Resolution No. 1 of 2016

RESOLUTION NO. 2 OF 201 6

A RESOLUTION AMENDING RESOLUTION NO. 3 OF 2015 AND RESOLUTION NO 1 OF 2016; ESTABLISHING A FEE OF FIVE DOLLARS ($5.00) FOR THE ISSUANCE OF ONE COUPON OR TEN DOLLARS ($10.00) FOR TWO COUPONS, IDENTIFYING QUALIFYING HOUSEHOLDS AS ELIGIBLE FOR DISPOSAL ON UP TO TWO (2) DAYS PER YEAR OF HOUSEHOLD WASTE AT THE SARDIS ROAD LANDFILL WITHOUT PAYMENT OF GATE CHARGES OR TIPPING FEES; AND, FOR OTHER PURPOSES

WHEREAS, The Saline County Regional Solid Waste Management Board (hereafter, the "Board") is authorized and empowered by the Arkansas Code, and specifically by ACA § 8-6-704(a)(6), to take the actions set out in this Resolution; and,

WHEREAS, On April 15, 2015, the Board adopted its Resolution 3 of 2015 establishing a fee of Five Dollars ($5.00) for the issuance of coupons for qualified resident households in Saline County as eligible for disposal of household waste at the Sardis Road landfill without payment of gate charges or tipping fees for up to two days per year; and,

WHEREAS, On August 17, 2016, the Board adopted its Resolution No. 1 of 2016 which continued the coupon fee at the rate of $5.00 for two coupons, made other changes in the rules regarding the coupon program declared that the fee might later be adjusted by the Board; and,

WHEREAS, Upon the recommendation of the Executive Director the Board has determined that an adjustment of the fee is necessary and prudent for the continuation of the coupon program; and,

WHEREAS, it is appropriate, fair and reasonable to amend the fee as set out in this Resolution for the issuance of coupons for qualified resident households in Saline County as eligible for disposal of household waste at the Sardis Road landfill without payment of gate charges or tipping fees for up to two days per year; and,

WHEREAS, Pursuant to thirty (30) days' public notice given in accordance with ACA § 25-15-204 the Board has conducted a Public Hearing on December 21, 2016, and has solicited comments from the public regarding the substance of this Resolution; and,

WHEREAS, The Board has considered all public comment and other information presented to it and has determined that taking the action set out herein in in the best interest of the Saline County Regional Solid Waste Management District and is in the best interest of the persons and entities served by the District;

NOW, THEREFORE, BE IT RESOLVED by the Saline County Regional Solid Waste Management District that:

SECTION 1 : Coupon Fee Adjusted. Beginning January 1, 2017, the District shall charge a fee of Five Dollars ($5.00) for each coupon, up to two for a total of Ten Dollars ($10.00) for two (2) coupons, for the issuance of a coupon or coupons to identify each household requesting the same as being eligible for one (1) day per coupon of disposal at the Republic Services Landfill located on Sardis Road, Bauxite, Arkansas.

SECTION 2 : Repealer. This Resolution amends Resolution No. 3 of 2015, and Resolution No. 1 of 2016, which shall remain in full force and effect as presently enacted except to the extent specifically set out in this Resolution. All other Resolutions of the Board and parts thereof in conflict with the provisions of this Resolution are, upon the effective date of this Resolution, repealed to the extent of such conflict, but not otherwise.

SECTION 3 : The application of this Resolution shall be effective and in force on and after the date of its passage and approval and shall be applicable to all the District Coupon Program beginning on January 1, 2017.
