Rule 003.00.22-002 - State Board of Embalmers, Funeral Directors, Cemeteries, and Burial Services Proposed Rule 4, "Fee Waivers for Certain Individuals"

RULE 4

FEE WAIVERS FOR CERTAIN INDIVIDUALS

Section 1.Authority

This Rule is promulgated pursuant to Section Four (4) of Act 725 of 2021 of the Arkansas General Assembly, codified at Ark. Code Ann. § 17-4-101et seq.; authority is also found in Ark. Code Ann. § 23-61-1103(a)(5), Ark. Code Ann. § 25-15-204, and other applicable laws or rules.

Section 2.Purpose

The purpose of this Rule is to waive the initial licensing fees for those individuals who are covered by the Workforce Expansion Act of2021, and who apply to the Board for an individual license.

Section 3.Deflnitions

"Initial licensing fee" means the following fees;

A. The application fee required for an Apprentice Embalmer;
B. The application fee required for an Apprentice Funeral Director;
C. The application fee required for a licensed Embalmer;
D. The application fee required for a licensed Funeral Director; and
E. The application fee required for a licensed Crematory Retort Operator.
Section 4.Requirements

The Board of Embalmers, Funeral Directors, Cemeteries, and Burial Services shall waive the initial licensing fee if the applicant:

A. Is receiving assistance through the Arkansas Medicaid Program; the Supplemental Nutrition Assistance Program; the Special Supplemental Nutrition Program for Women, Infants, and Children; the Temporary Assistance for Needy Families Program; or the Lifeline Assistance Program;
B. Was approved for unemployment within the last twelve (12) months; or
C. Has an income that does not exceed two hundred percent (200%) of the federal poverty income guidelines.
Section 5.Effective Date

This Rule is effective after review and approval by the Arkansas Legislative Council, ten (10) days after filing of the approved Rule with the Arkansas Secretary of State.
