Section 15 AAC 125.810 - Notification of orders and administrative proceedings
(a) In every administrative proceeding for the establishment or modification of support or the establishment or disestablishment of paternity, the agency will provide notice of each proceeding to each party to the proceeding and to individuals who are applying for or receiving services from the agency that relate to the application for or receipt of service by the agency. The agency will send the notice no less than seven days prior to the proceeding or review in question, unless a different amount of time is provided in the regulation or statute governing the proceeding. The agency will send the notice by first class mail or by electronic means to the last known address of the party or individual that is on file with the agency.
(b) In every action taken by the agency establishing or modifying a support obligation or concluding that there should be no change in the amount of a support obligation, the agency will send a copy of the order issued by the agency that establishes or modifies a support obligation or makes the determination that there should be no change in the amount of the child support award. The agency will send the copies to each party to the proceeding within 14 days after issuance of the order or determination, unless a shorter time is provided by the regulation or statute governing the issuance of the order or determination.
(c) When the agency has received an order or judgment from the court under AS 25.24.920, the agency will send a copy of the order or judgment to each party to the proceeding within 14 days after receipt. However, the agency may omit this requirement as to a party if it appears from the face of the document that the order or judgment has already been served on the party.
(d) In this section, "party" means:
(1) the custodial parent;
(2) the non-custodial parent;
(3) the original issuing tribunal, if other than the agency; and
(4) the initiating tribunal, if the agency is enforcing a support obligation at the request of another state.
