Section 770-X-10-.17-3-.03 - Narcotics, Amphetamines, And Other Dangerous Substances(1) No person shall operate, or be in physical control of, a motor vehicle if he possesses or is under the influence of, or is using, any of the following substances: (a) A narcotic drug or any derivative thereof;(b) Any amphetamine or any formulation thereof (including, but not limited to, "pep pills" and "bennies");(c) Any other substance, to a degree which renders him incapable of safely operating a motor vehicle.(2) No motor carrier shall knowingly require or permit a driver to violate paragraph (a) of this section.(3) Paragraph (a) of this section does not apply to the possession or use of a substance administered to a driver by or under the instructions of a physician who has advised the driver that the substance will not affect his ability to operate a motor vehicle.(4) As used in this section, "possession" does not include possession of a substance which is manifested and transported as part of a shipment.Ala.
