Section 420-5-9-.03 - The Governing Authority

(1) An FED and its parent hospital shall have an effective governing authority that is legally responsible for the conduct of the FED and parent hospital as an institution. The Governing Authority governing authority of the parent hospital shall provide administrative oversight for the care and services of the FED. The Governing Authority parent hospital's governing authority shall comply with the Board's Rules for Hospitals, Chapter 420-5-7, Ala. Admin. Code.

(2) Contracted services. The Governing Authority governing authority shall be responsible for services furnished in the FED whether or not they are furnished under contracts. The Governing Authority governing authority shall ensure that a contractor of services (including one for shared services and joint ventures) furnishes services that permit the FED to maintain compliance with the requirements of these rules.

(a) The Governing Authority governing authority shall ensure that the services performed under a contract are provided in a safe and effective manner.

(b) The Governing Authority FED shall maintain a list of all contracted services, including the scope and nature of the services provided.
