Notice of Lodging of Consent Decree Pursuant to Clean Air Act

Notice is hereby given that on February 27, 2007, a proposed consent decree in United States v. E.I. DuPont de Nemours & Co., Inc., Civil Action No. 07-930 (JBS), was lodged with the United States District Court for the District of New Jersey.

The proposed consent decree will settle the United States' claims for violation of the Clean Air Act, 42 U.S.C. 7412 and 7413, at the DuPont Environmental Treatment, Chambers Works (“DET”), located in Deepwater, New Jersey. Pursuant to the proposed consent decree, E.I. DuPont de Nemours & Co., Inc., will pay $322,000 as civil penalty for such violations and prepare and submit reports with respect to future activities at the DET.

The Department of Justice will receive for a period of thirty (30) days from the date of this publication comments relating to the proposed consent decree. Comments should be addressed to the Assistant Attorney General of the Environment and Natural Resources Division, and either e-mailed to pubcomment-ees.enrd@usdoj.gov or mailed to P.O. Box 7611, U.S. Department of Justice, Washington, DC 20044-7611, and should refer to United States v. E.I. DuPont de Nemours & Co., Inc., Civil Action No. 07-930 (JBS), D.J. Ref. 90-5-2-1-08003.

The proposed consent decree may also be examined at the Office of the United States Attorney, District of New Jersey, 970 Broad Street, Suite 700, Newark, New Jersey, and at U.S. EPA Region 2, 290 Broadway, New York, New York.
