AMENDED MEMORANDUM OF DECISION ON MOTION TO FILE UNDER SEAL


On October 14, 2003, this court issued an order refusing to seal certain files. That order applied to all requests to seal pending before the court.

On October 17, 2003, Connecticut General filed a Petition for Review. In its petition Connecticut General accurately recites and appears to rely on the court's finding "That the parties to the action have 72 hours from the issuance of the order in which to appeal the denial of the motion to seal." The court cited Practice Book § 11-20(f) for its finding. This cite was in error.

The court should have cited Practice Book § 11-20A(g) dealing with sealing files or limiting disclosure of documents. That section provides, "any person affected by a court order that seals or limits the disclosure of any files, documents or other materials on file with the court or filed in connection with a court proceeding, shall have the right to the review of such order by the filing of a petition for review with the appellate court within seventy-two hours from the issuance of such order."

The court's previous memorandum of decision of October 14, 2003 is reaffirmed in all other respects.

In all other respects the court's decision of October 14, 2002 is unchanged.
