CASE NO. 877 CRD-8-89-6

SEPTEMBER 27, 1990

The claimant was represented by Barry Jacobs, Esq., Jacobs Jacobs, P.C.

The respondents were represented by Brian Gildea, Esq.

This Petition for Review from the June 5, 1989 Finding and Dismissal of the Commissioner for the Eighth District was heard April 27, 1990 before a Compensation Review Division panel consisting of the Commission Chairman, John Arcudi, and Commissioners A. Thomas White, Jr., and James Metro.

OPINION

Claimant's appeal from the Eighth District's June 5, 1989 Finding and Dismissal was filed June 16, 1989. Respondents moved to dismiss as the Petition for Review was not filed within the ten day statutory period set out in Sec. 31-301 C.G.S.

We agree. See Famiglietti v. Dossert Corp., 804 CRD-5-88-12 (1990). See also, Rushton v. VIP Limousine, 756 CRD-7-88-8 (1989); Johnston v. ARA Services Inc., 7 Conn. Workers' Comp. Rev. Op. 19, 765 CRD-7-88-8 (1989).

We therefore grant Respondents' Motion and dismiss the appeal.

Commissioners A. Thomas White and James Metro concur.
