LIMITATIONS OF ACTION, § 27wages, 5-year statute. In action to recover wages for janitor work, where defendant had given plaintiff a check in payment but the bank had closed when he sought to cash it, the 5-year statute of limitations barred the action where oral promise to pay was made in May, 1931, and instant suit was brought in September, 1939.

Appeal from Municipal Court of Chicago; Hon. MASON S. SULLIVAN, presiding.

Reversed. Heard in first division, first district, this court at June term, 1940.
