In Rios, counsel for the defendant filed a no-merit brief under Anders v. California, 386 U.S. 738, 87 S.Ct. 1396, 18 L.Ed.2d 493 (1967), and we granted the motion to withdraw and dismissed the appeal. As in this case, Rios did not explicitly raise the 100:1 sentencing disparity, but did dispute that the drugs at issue were crack. The Supreme Court granted certiorari, vacated the judgment, and remanded for further consideration in light of Kimbrough. Rios, 128 S.Ct. 876.
