DECISION AND ORDER ON MOTION

Motion to dismiss appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied, without costs, and without prejudice to the issue involved being raised upon the argument of the appeal. Respondent shall, by personal service or overnight mail service, on or before August 4, 2014, file a supplemental brief solely containing arguments as to why the appeal should be dismissed. Appellant shall, on or before August 19, 2014, by personal service or overnight mail service, file a supplemental brief solely in response to the arguments raised by respondent in its supplemental brief.
