ORDER


AND NOW, this ____ day of March, 2004, upon consideration of Defendants' Motion to Dismiss (docket no. 4), it is ORDERED that the Motion is DENIED AS MOOT.

Defendants filed a Motion to Dismiss (docket no. 4) on July 7, 2003. Plaintiff filed an Amended Complaint on July 21, 2003. Defendants filed a Motion to Dismiss the Amended Complaint (docket no. 7) on August 8, 2003. Accordingly, the first Motion to Dismiss is moot.
