In Smith, the court affirmed convictions for attempted murder and assault with a deadly weapon to commit murder, but based its decision on People v. Schueren, 10 Cal.3d 553 [ 111 Cal.Rptr. 129, 516 P.2d 833], which dealt with the question of the sentences for assault with intent to commit murder (Pen.
