CAMERON MILES, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 16th District Court Denton County, Texas
Trial Court No. F17-418-158 Before Morriss, C.J., Burgess and Stevens, JJ. ORDER

Court reporter Michael Navarro recorded the trial court proceedings in appellate cause number 06-18-00147-CR, styled Cameron Miles v. The State of Texas, trial court cause number F17-418-158, in the 16th Judicial District Court of Denton County, Texas. A copy of this record has been requested by a family member of Cameron Miles.

Prior to releasing the reporter's record, we asked Navarro to redact sensitive data from the record. See TEX. R. APP. P. 9.10. Navarro has respectfully requested an order from this Court requiring the redaction.

March 13, 2018, we entered an order sealing the reporter's record because it contained "sensitive data," advised Navarro by letter of even date of the issuance of our sealing order, and advised him that, although redaction was not requested at that time, should the need arise in the future, we would ask Navarro to redact the record.

This record contains sensitive data. See TEX. R. APP. P. 9.10. Sensitive data includes, among other things, "a birth date, a home address, and the name of any person who was a minor at the time the offense was committed." TEX. R. APP. 9.10(a)(3). Rule 9.10(b) provides, "Unless a court orders otherwise, an electronic or paper filing with the court, including the contents of any appendices, must not contain sensitive data." The Rule further states, "The filing of a document constitutes a certification by the filer that the document complies with paragraphs (a) and (b) of this rule." TEX. R. APP. P. 9.10(e).

Having determined that the reporter's record contains sensitive data, as that term is defined by Rule 9.10, we hereby order Navarro to redact the reporter's record of any and all sensitive data it contains.

The redacted reporter's record is to be received no later than Wednesday, August 12, 2020. If the redacted reporter's record is not received by August 12, we warn Navarro that we may begin contempt proceedings and order him to show cause why he should not be held in contempt of this Court for failing to obey its order.

IT IS SO ORDERED.
