Summary

In McDaniel v. Port Authority of New York and New Jersey, 202 AD2d 222 (1st Dept. 1994), the Court did the very thing this court has done; changed the venue in a case with the very same defendants from Bronx County to another county after concluding that the county of occurrence was the proper venue.

Opinion

March 8, 1994

Appeal from the Supreme Court, Bronx County (Barry Salman, J.).

We perceive no abuse of discretion in changing venue to New York County where the accident occurred (Risoli v. Long Is. Light. Co., 138 A.D.2d 316, 318), since plaintiff resides and was treated in New Jersey.

Concur — Murphy, P.J., Carro, Wallach and Ross, JJ.
