MEMORANDUM OPINION


Appellant filed his notice of appeal with the trial court on March 18, 2005. Appellant did not file an affidavit of indigence with his notice of appeal. On August 2, 2005, appellant filed a motion to proceed in forma pauperis. In an order dated August 15, 2005, we denied appellant's motion to proceed in forma pauperis. We directed appellant to pay the $125 filing fee within ten days and warned him that failure to pay the required fee would result in the dismissal of this appeal for want of prosecution. On September 30, 2005, we received a letter from appellant stating that he cannot pay the $125 filing fee because of indigence.

As of today's date, appellant has not paid the $125 filing fee. Accordingly, we DISMISS this appeal. See Appendix to the Tex.R.App.P. B(1)(a); Tex.R.App.P. 5 42.3 (b), (c).
