GUARANTY, § 9guaranty given simultaneously with sale of mortgage as supported by common consideration. In an action to recover upon the guaranty of payment of third-mortgage notes, where the sale of the notes was completed and the guaranty of payment took place on the same day, the consideration paid supported both the sale of the mortgage and defendant's guaranty.

Appeal from Circuit Court of Cook county; Hon. RAY D. HENSON, presiding.

Judgment affirmed. Heard in third division, first district, this court at February term, 1941.
