Opinion

No. 05-05-01311-CV

Opinion issued November 30, 2005.

On Appeal from the 254th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 03-19226-R.

Dismissed.

Before Justices FITZGERALD, LANG-MIERS, and MAZZANT.

MEMORANDUM OPINION

Nakea C. Noble filed a notice of appeal on September 26, 2005. By separate letters dated September 26 and 27, 2005, we notified appellant that the $125 filing fee was due, the docketing statement was due, and the notice of appeal was defective. We gave appellant ten days to pay the filing fee and file a docketing statement; we gave appellant thirty days to file an amended notice of appeal correcting specific deficiencies. The letters cautioned appellant that failure to comply with the Court's instruction would result in the appeal being dismissed.

As of this date, appellant has not paid the filing fee, filed a docketing statement, or filed an amended notice of appeal. Accordingly, on the Court's own motion, we DISMISS the appeal. See Appendix to the Tex.R.App.P. B(1)(a); Tex.R.App.P. 5, 25.1(d), 32.1, 42.3.
