In a juvenile delinquency proceeding pursuant to Family Court Act article 3, the appeal is from an order of the Family Court, Nassau County (Medowar, J.), dated October 7, 1998, which, after a hearing, extended the appellant's placement with the New York State Office of Children and Family Services for a period of 12 months.

DECISION ORDER
ORDERED that the appeal is dismissed as academic, without costs or disbursements.
The appeal from an order which extended the appellant's placement is academic, as the period of placement has expired (see, Matter of Sammy C., 254 A.D.2d 415 ; Matter of C., 252 A.D.2d 524 ; Matter of Carlos S., 243 A.D.2d 569 ).

DECISION ORDER ON MOTION
Motion by the appellant on an appeal from an order of the Family Court, Nassau County, dated October 7, 1998, which extended his placement until October 7, 1999, to consider the appeal on its merits despite the fact that the order of placement has expired. By decision and order on motion dated October 28, 1999, the motion was held in abeyance and was referred to the Justices hearing the appeal for their determination.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, and upon the argument of the appeal, it is
ORDERED that the motion is denied.
