WHEREAS, by Minute Order dated October 6, 2005, this Court continued the October 17, 2005 Scheduling Conference to October 31, 2005, at 8:30 a.m.
WHEREAS, lead counsel for Defendants HiEnergy Technologies, Inc. ("HIET") and Bogdan C. Maglich, Ph.D. ("Dr. Maglich") is scheduled to be out of the country from October 31 to November 5 on a required client corporate governance conference. Counsel for HIET and Dr. Maglich requested, and all participating counsel and parties in pro per agreed, to a resetting of the Scheduling Conference from October 31 to November 14, 2005 at 8:30 a.m. The parties are attempting to contact the Clerk to see if this date and time are available for the resetting of the Scheduling Conference.
NOW, THEREFORE, IT IS HEREBY STIPULATED by and between all parties of record that:
1. The Scheduling Conference scheduled for October 31, 2005 is hereby continued to November 14, 2005 at 8:30 a.m., or the next available date.
