Freeny v. Freeny

Appellate Court of Illinois
Feb 20, 1947
330 Ill. App. 616 (Ill. App. Ct. 1947)

Opinion

Gen. No. 43,897. (Abstract of Decision.)

Opinion filed February 20, 1947 Released for publication March 28, 1947

DIVORCE, § 138when husband compelled to pay wife's attorney's fees and suit money. Where husband, seeking divorce, appealed from decree of dismissal of his complaint for want of equity, subsequent decretal order that husband pay wife $250 on account of suit money and attorney's fees was held proper because, from nature of case as shown by court record, justice demanded that wife be allowed reasonable sum in defending decree of dismissal, since court was satisfied husband would resort to improper methods to obtain divorce.

Appeal from the Circuit Court of Cook county; the Hon. ELMER J. SCHNACKENBERG, Judge, presiding.

Decretal order entered June 24, 1946, and decretal order entered June 28, 1946, affirmed. Heard in the second division, first district, this court at the October term, 1946.

John D. Vosnos, for appellant;

Prescott, Burroughs Taylor, for appellee;

Euclid Louis Taylor, of counsel.
