TERMINATION Dismissing the Petition 37 C.F.R. §§ 42.5(a), 42.71(a) IPR2015-00151 Patent 6,259,381 B1 2 On March 27, 2015, with Board authorization, the parties filed a Joint Motion to Terminate Pursuant to 35 U.S.C. § 317. Paper 16. Accompanying the motion, the parties filed a true copy of a settlement agreement (Ex. 2021) with a Joint Request to File Settlement Agreement as Business Confidential Information Pursuant to 35 U.S.C. § 317. Paper 17. This matter is a preliminary proceeding 1 and a decision on whether to institute the trial has not been made. Under these circumstances, it is appropriate to terminate the proceeding. See 37 C.F.R. §§ 42.5(a), 42.71(a). This paper does not constitute a final written decision pursuant to 35 U.S.C. § 318(a). Accordingly, it is ORDERED that the Joint Motion to Terminate Proceeding Pursuant to 35 U.S.C. § 317 is granted; FURTHER ORDERED that the Petition for Inter Partes Review of the above-referenced patent is dismissed; and FURTHER ORDERED that the parties’ request that the settlement agreement (Ex. 2021) be treated as business confidential information, to be kept separate from the patent file, is granted. 1 A preliminary proceeding begins with the filing of a petition for instituting a trial and ends with a written decision as to whether trial will be instituted. 37 C.F.R. § 42.2.
