ORDER
The Petitioner’s Request for Review of the Regional Director’s Decision and
Order dismissing the petition, in which the Regional Director found that the Employer’s
non-professional Field Service Representatives (FSRs) do not share a sufficient
community of interest with an existing professional engineering unit to warrant inclusion
in a combined unit through a self-determination election, is denied. The Board will,
however, reinstate the petition and remand the case to the Regional Director to determine
whether the Petitioner desires to proceed to an election in a unit of the petitioned-for
FSRs. The Employer has indicated that it does not oppose an election in such a unit. See
Regional Director’s Decision and Order at 1 fn. 2 (“The Employer asserts the requested
voting group would constitute an appropriate stand alone bargaining unit….”); Regional
Director’s Supplemental Decision and Order at 28 (“Moreover, the Employer is willing
to proceed to an election in a standalone unit composed only of the petitioned-for
FSRs.”); Employer’s Statement in Opposition at 46 fn. 28 (“The Company has indicated
on multiple occasions that it would consent to an election in a bargaining unit consisting
of the FSR classification only. There is no dispute that such a unit would be appropriate
under the Act.”). It does not appear that the Petitioner has taken a clear, definitive
position on whether it is willing to proceed to an election in such a unit. Accordingly,
we remand this proceeding and instruct the Petitioner to inform the Regional Director,
within a reasonable period of time, whether it wishes to proceed to an election involving
a stand-alone unit of FSRs. If so, the Regional Director will consider whether the stand-
alone unit is appropriate, and proceed accordingly. If not, the Petition will be dismissed.
