In a concurrent Decision on Motions (Paper No. 345), we decided Agrium’s 1
and SCF’s motions for priority. We granted Agrium’s motion and denied SCF’s. 2
Accordingly, it is: 3
ORDERED that judgment on priority as to Count 2, the sole count in the 4
interference (Paper 199, p. 2) is entered against Senior Party Surface Chemists of 5

Florida, Inc.; 1
FURTHER ORDERED that Surface Chemists of Florida’s involved claims 2
1-14 of U.S. Application 11/708,756 (corresponding to Count 2) are herein 3
FINALLY REFUSED, 35 U.S.C. § 135(a); 4
FURTHER ORDERED that Surface Chemists is not entitled to a patent 5
containing claims 1-14 of U.S. Application 11/708,756; 6
FURTHER ORDERED that Agrium’s involved claims 1-4, 7-12, 14 and 7
15 of Patent 7,771,50, which have been disclaimed (Ex. 2004), are CANCELLED, 8
35 U.S.C. 135(a); 9
FURTHER ORDERED that the parties note the requirements of 35 U.S.C. 10
§ 135(c) and 37 CFR § 41.205 regarding the filing of settlement agreements; and 11
FURTHER ORDERED that a copy of this Judgment be placed in each of 12
the files of (1) Surface Chemist’s Application 11/708,756 and (2) Agrium’s Patent 13
7,771,505. 14
