DECISION AND CERTIFICATION OF REPRESENTATIVE
The National Labor Relations Board has considered objections to an election held
September 10 and 14, 2013, and the Regional Director's report recommending disposition of
them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of
ballots shows 21 ballots cast for and 12 ballots cast against the Petitioner, with 3 challenged
ballots, an insufficient number to affect the results.
The Employer filed timely exceptions to the Regional Director’s report. On April 11,
2014, the Employer withdrew its exceptions.
Accordingly, as there are no exceptions pending before the Board, and the time allowed
for such filing having expired, the Board adopts the Regional Director’s findings and
recommendations, and finds that a certification of representative should be issued.

CERTIFICATION OF REPRESENTATIVE
IT IS CERTIFIED that a majority of the valid ballots have been cast for New York State
United Teachers, American Federation of Teachers, AFL-CIO and that it is the exclusive
collective-bargaining representative of the employees in the following appropriate unit:
All full-time, regular part-time, teachers employed by the Employer at its facility
located at 137 West 25th Street, New York, NY, but excluding all other
employees, including office clerical employees, and guards, and supervisors as
defined in Section 2(11) of the Act
