block the petition and Request for Review of the Regional Director’s decision to dismiss the
petition are denied as they raise no substantial issues warranting review.1

1 In agreeing with the RD that the petition should be dismissed, we rely only on Cases 12-CA-
232037 and 12-CA-233513. The unfair labor practices alleged in those cases, if proven, would
preclude the existence of the question concerning representation.
For institutional reasons, Members Kaplan and Emanuel apply extant law in denying the
Employer’s Requests for Review. However, they would consider revisiting the Board’s blocking
charge policy in a future appropriate proceeding.
