DECISION AND ORDER
The National Labor Relations Board has considered objections to an election held
February 22, 2013, and the Regional Director's report recommending disposition of them. The
election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows
72 eligible voters, with 25 ballots cast in favor of withdrawing the authority of the bargaining
representative to require, under its agreement with the Employer, that employees make certain
lawful payments to the Union in order to retain their jobs, with 1 ballot cast against the
proposition, and no challenged ballots.
No exceptions have been filed to the Regional Director's report within the time provided.
Accordingly, the Board adopts the Regional Director's findings and recommendations.1

1 The Regional Director recommended overruling the Petitioner’s Objections 1 and 3, and found
that the Petitioner’s Objection 2 raised substantial and material issues of fact that may best be
resolved by a hearing. Accordingly, the Regional Director ordered that a hearing be conducted
regarding Objection 2.

ORDER
IT IS ORDERED that this proceeding is remanded to the Regional Director for Region 5
for further appropriate action consistent with his report.
