Section 445 - Foods (Adm. Code Section 1705)The Department of Agriculture shall have the power, and its duty shall be:
(a) To enforce the laws of the Commonwealth relating to the production, manufacture, transportation and sale of foods used for man, as well as every article entering into and intended for use as an ingredient in the preparation of foods for man;(b) For the purpose of enforcing such laws, from time to time, to purchase from wholesale or retail dealers samples of any food or drink, and have the same analyzed or examined, and prosecute the sale of adulterated, misbranded, or deleterious foods or drink;(c) To examine all cold storage warehouses, within the meaning of the laws of this Commonwealth, to ascertain whether they are kept in a sanitary condition, the wholesomeness of the food therein, and the time within which foods shall have been so kept;(d) To make such rules and regulations, including the adoption of definitions and standards, as shall be necessary for the enforcement of the laws of this Commonwealth relating to oleomargarine, food, drink, and cold storage warehouses;(e) For the purpose of enforcing such laws, to enter into any place where food is produced, manufactured, sold, or offered for sale, or kept, and to seize all articles of food produced, manufactured, sold, or offered for sale, or kept in violation of such laws.1929, April 9, P.L. 177, art.
