Section 91 - Effect of fraud and collusion

Any creditor who shall, upon such distribution, present a claim, whether in judgment or otherwise, which shall be so largely in excess of that which is actually due as to be fraudulent and collusive, or shall assist others in so doing; or shall collude with the insolvent to hinder, delay or defraud his creditors, or any of them; or shall have received a preference from the insolvent, in violation of the provisions of this act, and shall not voluntarily surrender the same to the assignee or receiver, shall be postponed to all other creditors on the distribution of the insolvent's estate.
