Section 7177 - Failure to execute process(a) Scope of section.--This section applies to a constable subject to all of the following:(1) The constable is entrusted with the execution of a process for the collection of money.(2) The constable, by neglect of duty, fails to collect the money.(3) The constable's security is used to pay the money.(b) Equitable interest.--The person that pays the security under subsection (a)(3): (1) has an equitable interest in the judgment; and(2) may collect the judgment in the name of the party that won the judgment. 2009, Oct. 9, P.L. 494, No. 49, § 2, effective in 60 days [12/8/2009].
