The Chairperson of the Commonwealth Elections Commission, together with the electoral representatives of the candidates, shall design a presidential ballot, in both official languages (Spanish and English), in a different color than those used in ballots to vote for officials nominated for public office in the Government of Puerto Rico. Subject to the provisions of this section, the Chairperson and the electoral representatives shall determine the design and the text to appear in print on the presidential ballot, through a resolution. These ballots shall be uniform in size, the text thereon shall be printed in Spanish and English, and black ink shall be used on thick paper, so that the text printed does not show through the back. The provisions of Section 5.011 of the Electoral Law, including what is provided regarding write-in nominations, shall not apply to presidential ballots.
The insignia or logo of the national party, the name of the party, and the photograph of the United States presidential candidate shall appear at the top of the corresponding column, leaving enough space for the voter to make his/her mark. Immediately under the column, the phrase “Presidential Electors” shall appear in print, and under this phrase the names of the candidates, with a description of the office to which they have been nominated. The names of the candidates shall be centered, approximately half an inch apart, and to the left, enough space shall be left for a number and any valid voting mark.
The order or column in which the names of the United States presidential and vice presidential candidates is to appear shall be determined by lot, by the Chairperson of the Commonwealth Elections Commission in the presence of the electoral representatives of the candidates for the Presidency of the United States. The instructions to vote shall also appear in print on each ballot. The names of the presidential electors shall not appear on the ballot.
The United States presidential candidates participating in the presidential election held in Puerto Rico shall submit to the Chairperson of the Commonwealth Elections Commission, the name and photograph and the insignia to be placed on the ballot as the candidate’s logo, which shall be made through a certification to that effect, submitted on or before sixty (60) days prior to the presidential election. If the corresponding certification is not received, the Chairperson shall assign a geometric shape as the candidate’s logo.
For the presidential election of November 7, 2000, candidates shall have a twenty-(20) day term from effective date of this act to submit the logo which will appear on the ballot.
