Section 61-107.3.I.D - Penalties1. The Department may impose civil penalties not to exceed ten thousand dollars ($10,000), for each day of violation, for violations of the regulation.2. A person who willfully violates this regulation is guilty of a misdemeanor and, upon conviction, must be fined not more than ten thousand dollars ($10,000) for each day of violation, or imprisoned for not more than one (1) year, or both.3. If the conviction is for a second or subsequent offense, the punishment must be a fine not to exceed twenty-five thousand dollars ($25,000) for each day of violation, or imprisonment not to exceed two (2) years, or both.S.C.
