Section 302.6 - Retroactive tuition obligations; refund of tuition paymentsEffective September 1, 1963 the payment of retroactive tuition obligations or refund of previous tuition payments shall be governed by the following regulations.
(a) Any student who transfers or had transferred from a free tuition program of any State- operated unit of State University to a program for which tuition was required at the time he was enrolled in a free tuition program shall pay a tuition for the period of his attendance in such free tuition program of $162.50 a semester if enrolled as a full-time student or $15.25 a credit hour if enrolled as a part-time student. For any semester after January 1962 a full-time student who was a resident of New York State and entitled to a student incentive grant during such semester shall be charged $112.50 a semester. Such tuition shall be paid before the student is awarded his degree unless arrangements satisfactory to the chief administrative officer of the college have been made for payment of the tuition after graduation by the student.(b)(1) Any student who has transferred or shall transfer from any program for which tuition was charged in any State-operated unit of State University to a program for which no tuition was charged during all or any part of such student' s attendance shall be entitled to receive a refund of the amount of tuition paid by him for such period when no tuition was payable by students enrolled in the program to which he is transferred, less the amount of any assistance under the scholar incentive program received by him for such period and also less that part of the amount of any scholarship aid, if any, received by him for such period under article 13 of the Education Law, to which he would not have been entitled if enrolled in a program for which no tuition was charged.(2) The amount of any refund to which a student become entitled hereunder necessary to discharge any amount of tuition which is then due any payable by him shall be credited to such tuition liability and the balance, if any, shall be paid to such student, or at his election, may be credited to future tuition charges as they become due.N.Y.
