Section 3.35 - Public schools(a) No school district shall receive any apportionment of funds unless it submits all required reports, maintains an approved course of study, provides a school building and site in conformity with the requirements of the Education Law, the rules of the Regents and the regulations of the commissioner, and meets all other requirements of law. No school district shall receive any apportionment of funds based upon attendance of pupils at a secondary school unless such school: (1) makes general use of the Regents examinations in the senior high school grades; and(2) requires each class throughout its course to have during each school week a minimum of four recitations in English, which shall include the study of the language and literature and practice in composition.(b) Nothing in this section shall prohibit an apportionment to any school whose courses have been approved and whose examinations are accepted in lieu of Regents examinations, provided such schools meet all other requirements, or an apportionment to duly chartered and registered libraries pursuant to law.N.Y.
