Section 5-1.21 - Siting requirementsBefore a person shall enter a financial commitment for or initiate construction of a public water system, such person shall notify the State and, to the extent practicable, avoid locating part or all of the public water system at a site which:
(a) is subject to a significant risk from earthquake, floods, fires or other disasters; or(b) except for intake structures, is within the floodplain of a 100-year flood or is lower than any recorded high tide.N.Y. Comp. Codes R. & Regs. Tit. 10 §§ 5-1.21
