Section Adm 209.01 - Continuances(a) Any party or intervenor may make an oral or written motion that a hearing be delayed or continued to a later date or time.(b) A motion for a delay or a continuance shall be granted if the presiding officer determines that a delay or continuance would likely assist in resolving the case fairly, such as by allowing for the presence of a necessary party or witness who was unavoidably unavailable, and would not be contrary to law.(c) If the later date, time and place to which the hearing will be delayed or continued are known at the time of ruling on a motion, the information shall be stated on the record. If the later date, time and place are not known at that time, the presiding officer shall as soon as practicable issue a written scheduling order stating the date, time and place of the delayed or continued hearing.N.H.
