In 2003, pursuant to P.L. 2003 c. 689, the 121st Legislature created a new Department of Health and Human Services (hereafter, "the Department"), charged with the mission of providing health and human services to the people of Maine. 22-A M.R.S.A. §101et seq. The Department is the successor in every way to the powers, duties and functions that were formerly assigned to the Department of Human Services (DHS) pursuant to 22 M.R.S.A. §1et seq., and to the Department of Behavioral and Developmental Services (BDS) pursuant to 34-B M.R.S.A. §1001et seq.
This rule establishes the Department's policies governing its purchase of services. It repeals and replaces the following rules:
