The superintendent shall consider a request for payment providing the applicant:
(a) Is a California resident.(b) Is enrolled in an institution which has met the criteria specified in Section 18832 for participating in the fund and which has ceased operation, as determined by the superintendent.(c) Has made a direct payment to an institution for training, s specified in Section 18832.(d) Has unused prepaid tuition to his or her credit. Unused, as used in this subsection and Section 18838, refers to that portion of instruction and related goods and services never received as a result of school closure but for which direct payment of prepaid tuition has been made. With respect to any goods received, only those which are not useful independently of the instruction may be considered.(e) Has requested settlement from the closing institution which has not been resolved to the applicant's satisfaction.(f) Makes application within 60 days following the date the institution ceases operation.Cal.
