Zunic v. Franc

Appellate Court of Illinois, First District
Jan 1, 1939
302 Ill. App. 557 (Ill. App. Ct. 1939)

Opinion

Gen. No. 40,721. (Abstract of Decision.)

1939.

ASSOCIATIONS, § 5expulsion of members. Lower court was justified in finding that plaintiffs, members of a fraternal organization, were slandered at a meeting wherein they were allegedly characterized as "gangsters, hoodlums, bootleggers and murderers," and that such words constituted slander per se; but where plaintiffs had actually committed an assault upon another member, the association was justified in expelling them, where it followed substance although not letter of the by-laws.

See Callaghan's Illinois Digest, same topic and section number.

Appeal from Circuit Court of Cook County; Hon. ROMAN E. POSANSKI, presiding. Judgment against Jan Franc and Vaclav Seba affirmed; judgment against Vzdelavaci A Podporujici Spolek "Ilova" reversed. Heard in third division, first district, at June term, 1939.

Joseph E. Serhant and Wright Kamin, for appellants; Leo J. Pelej and Alfred Kamin, of counsel; B. M. Steiner, for appellees.
