THE COURT

The opinion of this court filed August 19, 2008 (165 Cal.App.4th 1603;___Cal.Rptr.3d___), in the above entitled case is modified as follows and the petition for rehearing is DENIED:

On page 23, 11th line down [165 Cal.App.4th 1621, 1st line], put a period after “section 7” and delete the rest of the sentence ending with “exemptions.” Keep the footnote in and put it after the period.

As modified, the petition for rehearing is denied. This modification does not effect a change in the judgment.
