PEGGY ZLATKIN v. JOHN MANSOUR

LC No. 2019-172613-NO

ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.211(E)(2), orders:

The motion to strike appellants' brief and dismiss this appeal is DENIED. Appellants' brief was not untimely. Per this Court's order dated October 21, 2021, appellants had until December 31, 2021, to file their brief. December 31, 2021 was a Court holiday and the Court was closed. Therefore, the brief was timely filed on the next Court business day: Monday, January 3, 2022. Because of a clerical error, the appellants' brief was initially docketed as untimely. That error has now been corrected.

However, on the Court's own motion, the appellants' brief that was filed on January 3, 2022, is STRICKEN because appellants have failed to cure the defects outlined in the January 4, 2022, defective filing letter. This case is now dismissed.
