BY THE COURT.

The circuit court's order entered April 1, 1976 dismissing this case on the ground that Section 768.133, Florida Statutes (1975), violates the constitution is reversed. Carter v. Sparkman, 335 So.2d 802 (Fla. 1976). This case is remanded for further proceedings.

It is so ordered.
